Advertising by internet pharmacies – II
In 2017 and 2018, various fines were imposed by the Minister of Medical Care on the operator of this website (“Dokteronline”), located in Curaçao, for (1) offering without a license so-called UR and UA medicines and advertising such medicines, as well as (2) selling medicines online to Dutch consumers, while it does not have the mandatory EU logo for the online sale of medicines.
The Works Council has the right to be informed in detail of planned measures to mitigate the social impact for employees
When requesting the advice of the Works Council pursuant to the Dutch Works Council Act an overview must be provided of (a) the consequences of the intended decision for the employees and (b) the social measures to be taken in this respect.
ACM imposes fine of almost 40 million euros on Samsung for influencing (resale) prices
On 14 September 2021 the Dutch competition authorities (ACM) imposed a fine of almost 40 million euros on Samsung Electronics Benelux B.V. (Samsung). In the opinion of the ACM, Samsung exerted undue influence on the online sales prices of televisions of seven retailers from January 2013 to December 2018.
Unfair Trade Practices in Agriculture and Food Supply Chain Act adopted and in force by 1 November 2021
The Unfair Commercial Practices in Agriculture and Food Supply Chain Act implements a European directive on this subject and will take effect on 1 November 2021. The purpose of the Act is to strengthen the position of the farmer in the chain.
The law focuses on companies that are active in the agricultural and food supply chain.
SER advice labour market; important new legislation on the way
On 14 June 2021, the SER presented an ‘advisory report on the labour market’ jointly drawn up by employers’ and employees’ organisations. It is expected that this advice will lead to important adjustments of labour legislation.
